How can I use licensed logos for commercial use?
My fiance and I are researching information on starting a home based glass etching / engraving business... I am a bit confused on copyright laws as we will not be mass producing any one item.. Most of our items will be custom made with a saying, symbol, and / or personalization.. I know we are safe with engraving Happy Birthday John on a glass or even etching a flower or other standard symbol but what about licensed logos like disney characters, NFL logos etc...... For example If someone requests the FSU logo to be etched onto a wine glass or Tinkerbell on a candy jar am I allowed to do this? Would I have to buy licensing rights just for the few products that may be requested? Please help answer this question or guide me to a website that will answer it - Thanks !!!
You can not use a copyrighted logo with out the permission of the entity that holds the copy right.
Therefore, if someone wants the FSU logo...you can not use it with out the permission of FSU. However, you could etch the words FLORIDA STATE UNIVERSITY on the glass.
The logo's characters etc are copyrighted to protect their use. If you go into a FSU book store you will find FSU glass ware that is approved by the university. Someone has paid the university a lot of money for the right to use that logo on their glassware. You have not paid. Therefore, you do not get to legally compete against the officially licensed product.
When in doubt, consult an attorney.
But go ahead and plan NOT do to any product that has a trademarked, copyrighted etc logo, character etc.
